1. Agreement to Terms

By accessing or using oasisretreatsusa.com, submitting an inquiry, or completing a reservation through any Oasis Retreats channel, you confirm that you are at least 18 years of age (21 years or older for properties designated as such), possess the legal capacity to enter into binding contracts, and have read, understood, and agree to be bound by these Terms of Service in their entirety.

If you do not agree with any part of these Terms, please do not use our website or proceed with a booking. These Terms apply to all guests, visitors, and any person who accesses services offered by Oasis Retreats USA LLC.

2. About Oasis Retreats

Oasis Retreats USA LLC is a Wyoming limited liability company that manages and operates curated vacation rental properties across Florida (Boynton Beach, Pompano Beach), North Carolina (Raleigh, Durham), and Missouri (St. Louis). We connect design-forward travelers with thoughtfully crafted homes and provide end-to-end property management services for property owners and investors.

3. Booking & Reservations

All reservations are processed through our secure booking platform at oasis.directbyhost.com. Completing a reservation constitutes a binding agreement between you and Oasis Retreats LLC, governed by these Terms and the specific booking confirmation issued to you at checkout.

You are solely responsible for the accuracy of all information provided during booking, including guest names, contact details, arrival and departure dates, and any special requests. Inaccuracies that result in losses or fees are your responsibility.

4. Pricing & Payment

All prices are displayed in US Dollars (USD) and are inclusive of all fees stated at the time of booking. Applicable taxes and service charges are itemized at checkout before you confirm.

• A deposit (amount varies by property) is required at the time of booking to secure your reservation.
• The remaining balance is due 30 days before check-in. For reservations made fewer than 30 days before check-in, full payment is collected at booking.
• Payments are processed via the DirectByHost platform using major credit cards. Oasis Retreats does not store payment card data.

5. Cancellation & Refunds

We understand plans change. Our standard cancellation policy is tiered by how far in advance you cancel relative to your check-in date:

• 60+ days before check-in: Full refund minus a processing fee (displayed at booking).
• 30–59 days before check-in: 50% refund of the total booking amount.
• Fewer than 30 days before check-in: Non-refundable. Extenuating circumstances will be considered on a case-by-case basis at our discretion.

Approved refunds are processed within 10 business days to the original payment method. We strongly recommend purchasing travel insurance to protect your investment against unforeseen cancellations.

6. Security & Damage Deposits

A security deposit (ranging from $250 to $1,000 depending on the property) is collected as an authorization hold on your payment card prior to or at check-in.

• Properties are inspected within 48 hours of checkout. If no damage is found beyond normal wear and tear, the hold is fully released.
• Any deductions for documented damage will be itemized and communicated to you in writing before any charges are finalized.
• The remaining balance (if any) is released within 14 business days of checkout.
• You have the right to formally dispute any damage claim. Disputes must be submitted in writing to legal@oasisretreatsusa.com within 7 business days of receiving the itemized deduction notice.

7. Guest Responsibilities & House Rules

As a guest, you are responsible for maintaining the property in the condition in which you found it. You and all members of your party agree to:

• Treat the property, furnishings, and equipment with care and respect.
• Observe quiet hours between 10:00 PM and 8:00 AM local time and be considerate of neighbors and the surrounding community.
• Not exceed the maximum occupancy stated in the property listing.
• Refrain from smoking indoors. Designated outdoor smoking areas, if any, are noted in the property guide.
• Not host events, parties, or gatherings beyond the stated guest count without prior written approval from Oasis Retreats.
• Report any damage, malfunction, or maintenance issues promptly by contacting us at hello@oasisretreatsusa.com.
• Comply with all applicable local ordinances, HOA rules, and community guidelines.
• Use parking only in designated spaces for the property.

Guests are financially liable for any damage beyond normal wear and tear. Oasis Retreats reserves the right to charge the payment method on file for documented damage costs.

8. Pet Policy

Pet-friendly accommodations vary by property and are clearly indicated on each listing. Before bringing any animal, please verify the pet policy for your specific reservation.

• Bringing an undisclosed pet to a property — whether pet-friendly or not — will result in an automatic additional fee of $500.
• Guests are fully liable for any damage caused by their animals, regardless of whether the property is designated pet-friendly.
• Pets must be kept off furniture unless otherwise noted in the property guide.

9. Check-in & Check-out

Standard check-in time is 4:00 PM and check-out is 11:00 AM local time. Early check-in or late check-out may be available on request, subject to availability, and may incur an additional fee.

Access instructions (including smart lock codes or key locations) are provided via email and the booking platform 24–48 hours before your arrival. You are responsible for securing the property upon departure — all doors and windows locked, all appliances turned off, and the property left in a clean and orderly condition consistent with our checkout checklist.

10. Property Descriptions & Accuracy

We strive to provide accurate, up-to-date descriptions, photography, and amenity information for every property in our portfolio. Photographs are representative of each home's character and furnishings; minor variations in décor, layout, or seasonal appearance may occur.

In rare circumstances — including unforeseen maintenance issues or property unavailability beyond our control — Oasis Retreats reserves the right to substitute a comparable or superior property. We will communicate any such change to you as promptly as possible and work to ensure the substitution meets or exceeds your original booking expectations. If a comparable substitute is unavailable, a full refund will be issued.

11. Limitation of Liability

Oasis Retreats provides vacation rental properties on an as-is basis and makes no warranties beyond those expressly stated in these Terms. To the fullest extent permitted by applicable law:

• Our total liability to you for any claim arising from or related to your booking shall not exceed the total amount you paid for the reservation in question.
• We exclude liability for any indirect, consequential, incidental, special, or punitive damages, even if advised of the possibility of such damages.
• We are not liable for personal injury or property damage except where directly caused by our gross negligence or willful misconduct.
• We are not responsible for interruptions to utilities (electricity, water, gas), internet outages, cable or streaming service disruptions, or weather events.
• We are not liable for delays, cancellations, or failures caused by third-party service providers (cleaners, maintenance vendors, or local authorities).
• We are not responsible for theft, loss, or damage to your personal property during your stay.

Nothing in these Terms limits our liability for fraud, death, or personal injury resulting from our negligence, or any liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Oasis Retreats USA LLC, its members, managers, employees, contractors, and property partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of any property in violation of these Terms.
• Damage caused by you or any member of your party during the stay.
• Your violation of any applicable federal, state, or local law or regulation during your stay.
• Any illegal activity conducted on the property by you or your guests.

13. Force Majeure

Neither party shall be in breach of these Terms for any delay or failure to perform caused by circumstances beyond reasonable control, including but not limited to: natural disasters, hurricanes (particularly relevant to our Florida properties), floods, wildfires, pandemics, government-mandated lockdowns or travel restrictions, or acts of terrorism.

In the event of a qualifying force majeure circumstance affecting your reservation, Oasis Retreats will offer one or more of the following options at the company's discretion based on the specific circumstances:

• A full credit for a future stay of equal value, valid for 18 months.
• Rescheduling to alternative dates, subject to availability.
• A full or partial refund, where conditions allow.

14. Dispute Resolution

We are committed to resolving disputes fairly and efficiently. The following three-step process applies to any claim arising from these Terms or your use of our services:

• Step 1 — Informal Resolution (30 days): Before initiating any formal proceeding, you must contact us at legal@oasisretreatsusa.com with a written description of the dispute. We will make good-faith efforts to resolve it within 30 days.
• Step 2 — Mediation: If informal resolution fails, both parties agree to non-binding mediation in Sheridan, WY, before a mutually agreed-upon mediator. Mediation costs are shared equally unless otherwise agreed.
• Step 3 — Binding Arbitration: If mediation does not resolve the dispute, it will be submitted to final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Sheridan, WY. Each party bears its own costs unless the arbitrator finds a claim frivolous.

Either party may bring claims in small claims court for disputes valued under $10,000, provided the matter qualifies for such jurisdiction. You and Oasis Retreats USA LLC each waive the right to participate in any class action lawsuit or class-wide arbitration.

15. Intellectual Property

All content on oasisretreatsusa.com — including text, photography, videography, graphics, logos, brand elements, and software — is the exclusive property of Oasis Retreats USA LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content without our prior written permission. To report a copyright infringement (DMCA takedown request) or seek permission for use, contact legal@oasisretreatsusa.com.

16. User Content

By submitting reviews, testimonials, feedback, or other content through our platform or third-party review sites, you grant Oasis Retreats USA LLC a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, and display such content for marketing and operational purposes.

You represent that all submitted content is truthful, based on genuine experience, and does not infringe any third-party rights. Content that is defamatory, obscene, or unlawful will be removed without notice.

17. Non-Discrimination

Oasis Retreats USA LLC is committed to full compliance with the Fair Housing Act and all applicable federal, state, and local anti-discrimination laws. We do not discriminate in the provision of our services on the basis of race, color, religion, national origin, sex, familial status, disability, sexual orientation, gender identity, or any other characteristic protected by law.

18. Accessibility

Oasis Retreats USA LLC is committed to making our website and properties accessible to all guests. Our website targets WCAG 2.1 Level AA compliance, and we continuously work to improve the digital experience for users with disabilities.

If you have specific accessibility requirements or need accommodations beyond what is listed, please contact us at hello@oasisretreatsusa.com before booking and we will do our best to meet your needs or recommend a suitable property.

19. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

Any legal action or proceeding arising under or in connection with these Terms that is not subject to the arbitration clause above shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming. By using our services, you consent to the personal jurisdiction of such courts.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.

21. Entire Agreement

These Terms of Service, together with your booking confirmation and any property-specific house rules provided at the time of booking, constitute the entire agreement between you and Oasis Retreats USA LLC with respect to your use of our website and services. They supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.

22. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. A waiver of any breach or default does not constitute a waiver of any subsequent breach or default, and will not affect the other terms of these Terms.

23. Changes to Terms

Oasis Retreats USA LLC reserves the right to update or modify these Terms at any time. When we make material changes, we will notify users by email (where a booking or account relationship exists) and update the "Last updated" date at the top of this page. Non-material changes take effect upon posting.

Your continued use of our website or services after any change constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
